Overview
Welcome to Jesus Creations.
The terms “Jesus Creations,” “we,” “us,” and “our” refer to Maximal Trading LLC, doing business as Jesus Creations.
Jesus Creations operates this website and online store, including all related information, content, features, tools, products, and services, to provide customers with a curated shopping experience. Collectively, these are referred to as the “Services.”
Our store is hosted and powered by Shopify, which enables us to provide the Services to you.
These Terms of Service, together with our Privacy Policy, Refund Policy, and any other policies referenced in these Terms, describe your rights and responsibilities when accessing or using the Services.
Please read these Terms carefully. They contain important information concerning your legal rights, order obligations, warranty disclaimers, and limitations of liability.
By visiting, browsing, interacting with, placing an order through, or otherwise using the Services, you agree to be bound by these Terms of Service and our Privacy Policy.
If you do not agree to these Terms or our Privacy Policy, you should not access or use the Services.
Nothing in these Terms excludes, restricts, or modifies any consumer right or remedy that cannot lawfully be excluded, restricted, or modified under applicable law.
Section 1 — Access and Accounts
By agreeing to these Terms, you represent that you are at least the age of majority in your state, province, or country of residence.
You may allow a minor dependent to access the Services using a device you own or manage only under your supervision and where permitted by applicable law.
To browse our store, create an account, place an order, or use certain Services, you may be asked to provide information such as your name, email address, billing address, shipping address, telephone number, and payment details.
You represent and warrant that all information you provide is accurate, current, and complete and that you have the right to provide that information.
You are responsible for maintaining the confidentiality and security of your account credentials and for activity conducted through your account. You must notify us promptly if you believe your account has been accessed or used without authorization.
You may not sell, transfer, assign, or license your customer account to another person.
We reserve the right to refuse service, suspend accounts, cancel accounts, or restrict access to the Services where reasonably necessary to protect Jesus Creations, our customers, Shopify, our service providers, or third parties; to prevent fraud or misuse; or to enforce these Terms.
Section 2 — Our Artwork and Products
Jesus Creations offers decorative and inspirational artwork, including printed canvas wall art.
Unless a product listing expressly states otherwise, our canvas artwork is a flat printed reproduction on canvas. It is not an original hand-painted work and does not contain physically raised paint, brushwork, sculpted elements, or three-dimensional impasto texture.
Any visible brushstrokes, paint effects, surface texture, tile effects, gold effects, cracks, aged details, or similar artistic features shown within an artwork are part of the printed image unless the product description expressly states that they are physically applied.
Product photographs, room mockups, videos, close-up images, promotional materials, lifestyle images, and digital renderings are provided to help illustrate the artwork and how it may appear in a home or interior setting. They are representative and may not show the exact physical scale, lighting, framing, surroundings, or surface appearance experienced by every customer.
We make reasonable efforts to display our artwork and products accurately. However:
- Colours may appear differently depending on screen type, display calibration, brightness, lighting, and device settings.
- Printed colours may vary slightly from colours displayed digitally.
- Minor differences may occur between production runs.
- The visible composition or crop may vary slightly between available sizes or aspect ratios.
- Room mockups and lifestyle photographs may not represent exact-to-scale dimensions.
- Frames, decorative elements, furniture, or accessories shown in lifestyle images are not included unless expressly stated in the product listing.
Customers are responsible for reviewing the selected artwork, size, frame option, colour or style variation, shipping address, and other order details before completing their purchase.
Product dimensions shown on the website are approximate. Small manufacturing tolerances may occur.
Our artwork represents creative and artistic interpretations intended for decorative, inspirational, and faith-based purposes. Unless expressly stated otherwise, Jesus Creations does not claim that an artistic depiction is a historically exact, photographically exact, theologically definitive, or universally accepted denominational representation of any person, event, scene, symbol, or religious subject.
Individual viewers may interpret religious artwork differently. Differences in personal, theological, cultural, or denominational interpretation do not by themselves make an item defective or incorrectly supplied.
We may change product descriptions, product options, designs, pricing, availability, or other product information at any time without notice.
We reserve the right to discontinue a product or limit the quantities available to a person, household, geographic region, or jurisdiction.
Section 3 — Orders and Acceptance
By submitting an order, you make an offer to purchase the selected products under these Terms.
Receiving an order confirmation or payment authorization does not necessarily mean that we have accepted the order. An order is accepted when we confirm acceptance, begin production, or dispatch the product, whichever occurs first.
We reserve the right to accept, decline, limit, or cancel an order where reasonably necessary, including in cases involving:
- Suspected fraud or unauthorized payment
- Incorrect pricing or product information
- Product or material unavailability
- Shipping restrictions
- Suspected resale activity
- Abusive or unlawful conduct
- Technical or processing errors
- An inability to verify customer or delivery information
If we cancel an order after payment has been collected, we will refund the amount charged for the cancelled portion of the order to the original payment method, subject to applicable law.
You must review your order carefully before submitting it. This includes the artwork, artistic style, canvas size, frame selection, quantity, billing information, shipping address, email address, and telephone number.
Order Changes and Cancellations
Our canvases are individually produced after an order is placed.
Customers should request any cancellation or order change within 24 hours of placing the order by contacting help@jesuscreations.com.
During this 24-hour period, we will make reasonable efforts to process the requested change or cancellation before production advances. However, a request is not complete until we confirm it in writing.
After the initial 24-hour period, production may already have begun and our production partner may already have committed materials, labour, or production capacity to the order. As a result, changes or cancellations requested after 24 hours cannot be guaranteed.
Where production has not advanced too far, we may still attempt to accommodate a later request at our discretion. Any additional cost resulting from a customer-requested change after production begins may be charged to the customer where permitted by law and disclosed before the change is completed.
This order-cancellation process does not limit any mandatory cancellation, withdrawal, return, or consumer rights that apply under the laws of the customer’s country.
Returns and refunds after delivery are governed by our Refund Policy.
Section 4 — Personalization and Custom Orders
Certain products may allow personalization, special dimensions, custom artwork adjustments, customer-provided wording, or other specifications selected or supplied by the customer.
You are responsible for checking all names, dates, wording, images, instructions, dimensions, and other custom details before submitting an order.
We are not responsible for errors contained in information or materials supplied or approved by the customer, except where we fail to produce the item in accordance with the information accepted by us.
Once production of a personalized or custom product has begun, the order may not be changeable or cancellable.
Personalized products and goods made to a customer’s particular specifications may be excluded from change-of-mind returns or statutory withdrawal rights where permitted by applicable law. This exclusion does not affect rights relating to products that are defective, damaged, incorrectly supplied, or not produced according to the agreed specifications.
An ordinary canvas produced after an order is placed is not necessarily a personalized product. A product will be treated as personalized or custom-made for this purpose only where it has been created or materially modified according to customer-specific instructions or selections beyond the standard product options offered generally through our store.
Section 5 — Personal Use and Resale
Products purchased through the Services are intended for personal, household, decorative, or gift use.
You may not purchase our products for commercial resale, wholesale distribution, marketplace resale, export for resale, reproduction, rental, or other commercial exploitation without our prior written agreement.
Churches, interior designers, commercial decorators, retailers, distributors, and other organizations interested in placing a commercial, wholesale, or resale order must contact us and receive written approval before purchasing for that purpose.
We may cancel or restrict orders that we reasonably believe are intended for unauthorized resale or commercial distribution.
Purchasing a physical artwork does not transfer copyright, reproduction rights, licensing rights, merchandising rights, or any other intellectual-property rights in the artwork.
Section 6 — Prices, Promotions, and Billing
Prices, discounts, and promotions may change without notice.
The price charged for a product will generally be the price displayed when the order is placed, subject to correction of obvious errors.
Unless expressly stated otherwise, displayed prices may not include applicable sales tax, value-added tax, shipping charges, customs duties, import taxes, brokerage fees, handling charges, or other governmental charges.
Any applicable amounts calculated and collected by us will be displayed during checkout.
Customers are responsible for customs duties, import taxes, brokerage fees, or similar charges not collected during checkout, except where applicable law requires otherwise or the checkout expressly states that such charges are included.
Promotional offers may be subject to separate conditions, including eligibility requirements, expiration dates, size restrictions, product exclusions, minimum purchase amounts, or limits on use.
Promotional codes:
- Must be entered before checkout is completed
- Cannot be exchanged for cash
- May not be applied retroactively
- May not be combined unless expressly permitted
- May be limited to one use per customer or household
- May be cancelled where obtained or used fraudulently
If separate promotional terms conflict with these Terms, the specific promotional terms will control in relation to that promotion.
You agree to provide current, complete, and accurate billing, payment, account, and contact information.
You represent and warrant that:
- The payment information you provide is accurate and complete.
- You are authorized to use the selected payment method.
- Charges incurred through your order will be honoured by the relevant payment provider.
- You will pay all properly disclosed charges associated with your order.
Section 7 — Shipping and Delivery
Production and delivery timeframes displayed on the website or communicated by us are estimates unless expressly guaranteed in writing.
Because each canvas is individually produced, an order normally passes through production before it is transferred to a shipping carrier.
Delivery estimates may be affected by production demand, product size, frame selection, destination, carrier capacity, weather, customs processing, holidays, incorrect address information, failed delivery attempts, and other circumstances outside our reasonable control.
We are not responsible for delays caused solely by a carrier, customs authority, governmental action, force majeure event, or other circumstance outside our reasonable control. This does not affect any mandatory rights or remedies available to the customer.
Customers are responsible for providing a complete and accurate delivery address and any information reasonably necessary for delivery.
We are not responsible for delays, additional charges, or non-delivery caused by an incomplete or incorrect address supplied by the customer. Where possible, we will attempt to help correct an address before dispatch, but address changes cannot be guaranteed after production or fulfilment has begun.
Customers should monitor tracking information and make reasonable arrangements to receive large packages.
Where tracking records show that an order was delivered but the customer cannot locate it, the customer should:
- Check the delivery location and surrounding property.
- Ask household members, neighbours, reception staff, or building management.
- Contact the carrier.
- Contact us promptly if the package remains missing.
Nothing in these Terms transfers the risk of accidental loss or transit damage to a consumer earlier than permitted by applicable law.
Section 8 — Damaged, Defective, or Incorrect Items
Customers should inspect the package and artwork promptly after delivery.
If an item arrives damaged, defective, or materially different from what was ordered, contact help@jesuscreations.com as soon as reasonably possible.
To allow us and our production or shipping partners to investigate the issue, we may request:
- The customer’s order number
- Clear photographs or video of the outside of the shipping box
- Photographs of shipping labels
- Photographs or video showing damage to the packaging
- Clear photographs or video showing the complete artwork
- Close-up photographs or video of the damage or defect
- Photographs of the frame, canvas, corners, or hanging hardware
- Any additional information reasonably necessary to evaluate the claim
Customers should retain the product and all original packaging until we confirm whether they are needed for inspection, return, carrier review, or another resolution.
Failure to provide reasonably requested evidence may prevent us from confirming the nature or cause of the reported issue. However, this requirement will not be applied in a manner that unlawfully limits mandatory consumer rights.
Depending on the circumstances and applicable law, we may offer a replacement, repair, refund, partial refund, return, or another appropriate resolution.
Customers should not return a damaged, defective, or incorrect item unless we provide return instructions.
Section 9 — Returns and Refunds
Returns, refund eligibility, return-shipping responsibilities, inspections, refund processing, and related requirements are governed by our Refund Policy, which forms part of these Terms.
Our standard policy permits eligible return requests within 30 days after delivery, subject to the conditions stated in the Refund Policy.
Customers must contact us before sending a return. Products sent without prior authorization or without following the provided return instructions may be delayed, refused, or returned to the sender where permitted by law.
Nothing in our Refund Policy or these Terms limits rights relating to faulty, damaged, misdescribed, or incorrectly supplied goods where those rights cannot lawfully be limited.
Section 10 — European Union and United Kingdom Consumer Rights
Customers in the European Union or United Kingdom may have mandatory rights under local consumer law, including rights relating to pre-contract information, delivery, conformity of goods, faulty goods, cancellation, withdrawal, returns, and refunds.
Where applicable, an eligible consumer purchasing online may have the right to cancel or withdraw from the contract within 14 days after receiving the goods without providing a reason.
Exceptions may apply, including for goods made to the consumer’s specifications or clearly personalized.
The fact that a standard canvas is produced after an order is placed does not, by itself, necessarily mean that the product is personalized or made to the customer’s specifications for purposes of an applicable statutory exception.
Where an eligible customer exercises a statutory right of withdrawal:
- The customer must notify us within the applicable withdrawal period.
- The customer must return the goods within the period required by applicable law.
- The customer is responsible for the direct cost of return shipping where the law permits us to assign that cost to the customer and we have informed the customer accordingly.
- The customer may be responsible for diminished value resulting from handling beyond what is reasonably necessary to inspect the nature, characteristics, and functioning of the goods.
- Refunds will be issued according to the timing and payment requirements imposed by applicable law.
Nothing in these Terms overrides a mandatory consumer protection available in the customer’s country of residence.
Section 11 — Intellectual Property
The Services and their contents, features, and functionality are owned by or licensed to Maximal Trading LLC, Jesus Creations, our affiliates, or our licensors.
Protected materials may include:
- Artwork and artistic compositions
- Product designs
- Photographs and videos
- Digital renderings and mockups
- Website text and copy
- Logos and brand elements
- Product names and collection names
- Graphics and illustrations
- Page layouts and website design
- Audio
- Promotional materials
- Software and code
- The selection and arrangement of website content
These materials are protected by copyright, trademark, trade dress, and other intellectual-property laws in the United States and other countries.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable right to access and use the Services for personal, non-commercial purposes.
You may not, without our prior written permission:
- Copy or reproduce our artwork
- Download high-resolution product images for commercial use
- Print, manufacture, distribute, or sell reproductions
- Modify or create derivative works from our artwork or content
- Remove watermarks, copyright notices, or attribution
- Use our artwork in merchandise, advertisements, templates, publications, digital products, or commercial projects
- Upload our artwork to print-on-demand, artificial-intelligence, image-generation, or similar services
- Use our content to train, fine-tune, evaluate, or develop an artificial-intelligence model
- Publicly display, publish, transmit, license, or distribute our materials for commercial purposes
- Scrape, extract, index, or systematically collect our product information, images, or content
- Use our trademarks, names, product names, designs, or slogans without written permission
Purchasing a product gives you ownership of the physical item purchased but does not transfer any underlying intellectual-property rights.
“Jesus Creations,” our logos, product or collection names, designs, slogans, and related brand identifiers are trademarks or trade dress belonging to Maximal Trading LLC or its licensors.
Shopify’s names, logos, products, and service names are the property of Shopify.
All rights not expressly granted are reserved.
Section 12 — Customer Content, Reviews, Photographs, and Feedback
“Customer Content” means reviews, ratings, testimonials, photographs, videos, comments, messages, suggestions, ideas, feedback, social-media posts, and other content that you voluntarily:
- Submit through our website or review platform
- Upload in connection with a review or testimonial
- Send to us for publication or promotional consideration
- Post publicly while tagging or directly mentioning Jesus Creations
- Submit in connection with a promotion, competition, survey, or customer-content request
You retain any ownership rights you have in your Customer Content.
By submitting or making Customer Content available to us in one of the ways described above, you grant Maximal Trading LLC and Jesus Creations a worldwide, perpetual, irrevocable, non-exclusive, transferable, sublicensable, fully paid, and royalty-free license to:
- Use
- Reproduce
- Copy
- Store
- Edit
- Adapt
- Crop
- Translate
- Publish
- Display
- Distribute
- Create derivative promotional materials from
- Communicate to the public
- Use in advertising and marketing
This license applies in any format, channel, or medium now known or later developed, including our website, email, social media, digital advertising, printed material, product pages, and promotional campaigns.
To the extent permitted by law, you authorize us to use Customer Content with your first name, social-media username, general location, review details, or other attribution supplied with the content. We may also use the content without identifying you.
You agree that no additional approval, attribution, or compensation is required for a use permitted by this license.
You represent and warrant that:
- You created or control the Customer Content or have all permissions necessary to submit it.
- Our permitted use will not infringe another person’s copyright, trademark, privacy, publicity, personality, or other rights.
- Any people identifiable in the content have consented to its submission and permitted use.
- The content is truthful and reflects your genuine experience where presented as a review or testimonial.
- You have disclosed any incentive or compensation connected to the content.
- The content does not contain unlawful, defamatory, abusive, obscene, deceptive, or malicious material.
We may monitor, moderate, edit, refuse, or remove Customer Content at our discretion, subject to applicable law.
We are not obligated to publish Customer Content, maintain it in confidence, pay compensation for it, or respond to it.
Private payment information, identification documents, and other information submitted solely for customer-service, fraud-prevention, or transaction-processing purposes will remain subject to our Privacy Policy and will not be treated as promotional Customer Content merely because it was sent to us.
Section 13 — Optional and Third-Party Tools
We may provide access to tools, features, payment services, review systems, tracking services, social-media functions, or other services operated by third parties.
We do not necessarily monitor, control, or have input into those third-party tools.
To the extent permitted by law, access to third-party tools is provided “as is” and “as available,” without warranties, representations, or endorsement by us.
Your use of a third-party tool may be governed by separate terms and privacy policies established by the relevant provider. You are responsible for reviewing those terms before using the tool.
We may introduce new tools, resources, or features in the future. Unless stated otherwise, those additions will form part of the Services and will be governed by these Terms.
Section 14 — Third-Party Links
The Services may contain links to websites, materials, applications, or services operated by third parties.
We are not responsible for examining or evaluating the accuracy, availability, security, content, products, privacy practices, or policies of third-party websites.
Accessing a third-party website is at your own discretion and risk.
We are not responsible for harm or loss arising solely from your use of or reliance on a third-party website, product, resource, or service, except where such responsibility cannot lawfully be excluded.
Questions or complaints relating to a third-party product or service should be directed to the relevant third party.
Section 15 — Relationship With Shopify
Jesus Creations is powered by Shopify, which enables us to provide the Services.
However, purchases made through our store are transactions directly between you and Maximal Trading LLC, doing business as Jesus Creations.
Shopify is not the seller of Jesus Creations products and is not responsible for fulfilling orders, handling returns, evaluating products, or resolving sales disputes between you and Jesus Creations.
To the extent permitted by law, you release Shopify and its affiliates from claims, losses, damages, and liabilities arising directly from your purchase or use of products sold by Jesus Creations.
Nothing in this section limits any liability that cannot lawfully be excluded.
Section 16 — Privacy
Personal information collected through the Services is handled according to our Privacy Policy.
Because Shopify hosts the Services, Shopify may collect and process personal information relating to your access to and use of the Services in order to host, operate, protect, and improve the platform.
Information submitted through the Services may also be shared with service providers such as payment processors, production partners, shipping carriers, analytics providers, advertising providers, customer-service systems, and other partners as described in our Privacy Policy.
These providers may process information in countries other than the country in which you reside, subject to applicable data-protection requirements.
By using the Services, you acknowledge that you have been given the opportunity to review our Privacy Policy and any applicable Shopify privacy information.
Section 17 — Errors, Inaccuracies, and Omissions
Information on the Services may occasionally contain typographical errors, inaccuracies, technical errors, or omissions involving:
- Product descriptions
- Dimensions
- Artwork names
- Images
- Prices
- Discounts
- Promotions
- Availability
- Shipping charges
- Production estimates
- Transit estimates
- Delivery information
We reserve the right to correct errors, update information, withdraw an offer, or cancel an affected order at any time, including after an order has been submitted.
If we cancel an order because of an error after collecting payment, we will refund the amount charged for the cancelled product.
We are not required to update or clarify information except where required by law.
Section 18 — Prohibited Uses
You may use the Services only for lawful purposes and in accordance with these Terms.
You may not access or use the Services, directly or indirectly:
- For an unlawful, fraudulent, deceptive, or malicious purpose.
- To violate any international, federal, state, provincial, territorial, or local law.
- To infringe our intellectual-property rights or those of another party.
- To harass, threaten, abuse, insult, defame, intimidate, or harm another person.
- To transmit false, fraudulent, or misleading information.
- To impersonate another person or misrepresent your identity or authority.
- To submit fraudulent orders, payment disputes, claims, reviews, or evidence.
- To send unsolicited advertisements, spam, chain messages, or similar solicitations.
- To upload or transmit viruses, malware, harmful code, or destructive material.
- To interfere with the security, integrity, availability, or operation of the Services.
- To bypass access restrictions, fraud controls, rate limits, robot exclusions, or security measures.
- To collect, track, or misuse another person’s personal information.
- To reproduce, duplicate, copy, sell, resell, or commercially exploit any portion of the Services.
- To scrape, crawl, index, harvest, extract, or systematically collect website content or data.
- To use our Services or content to develop, train, fine-tune, benchmark, or operate an artificial-intelligence or machine-learning system without written permission.
- To purchase products for unauthorized commercial resale.
- To engage in conduct that restricts another person’s use of the Services or exposes Jesus Creations, Shopify, our customers, or our partners to harm or liability.
We may suspend or terminate access where we reasonably determine that a user has violated these Terms.
Section 19 — Automated Agents
19.1 Application
This section applies if you use, allow, enable, or cause an automated or semi-automated agent to access, use, or interact with the Services.
An “Agent” means software or a service that takes autonomous or semi-autonomous action on behalf of, or at the instruction of, a person or entity and can operate without direct human supervision.
19.2 Identification and Compliance
No Agent may access, use, or interact with the Services unless it clearly identifies itself and complies with this section.
An Agent must not access or continue accessing the Services if we have requested that the Agent stop.
19.3 Restrictions
We may use technical or other measures to limit or control whether and how an Agent accesses, uses, or interacts with the Services.
19.4 Agent Requirements
Agents must:
- Identify automated requests as originating from an Agent and disclose the Agent’s name in the applicable user-agent string using the format “Agent/[agent name].”
- Not conceal or disguise automated activity.
- Not mimic human interaction patterns to avoid detection.
- Not complete, bypass, or circumvent CAPTCHAs or other measures intended to distinguish humans from automated systems.
- Respond truthfully to prompts seeking to determine whether an interaction originates from a human or computer.
- Not bypass any measure intended to block, limit, modify, or control automated access.
- Comply with these Terms, our robots instructions, technical restrictions, and applicable law.
- Not use content obtained from the Services to train, fine-tune, improve, benchmark, or develop an artificial-intelligence model without our prior written permission.
Section 20 — Termination
We may suspend or terminate your account or access to all or part of the Services if:
- You breach these Terms.
- Your activity creates legal, security, fraud, operational, or reputational risk.
- We are required to do so by law.
- We discontinue the relevant Service.
- Your use interferes with the rights or experience of other users.
You remain responsible for amounts properly owed up to the effective date of termination.
Termination does not affect rights or obligations that arose before termination.
Sections concerning payment obligations, intellectual property, Customer Content, prohibited uses, termination, warranty disclaimers, limitation of liability, indemnification, severability, governing law, and any provision that by its nature should survive will remain effective after termination.
Section 21 — Disclaimer of Warranties
Information made available through the Services is provided for general informational, decorative, and commercial purposes.
We do not warrant that general website information will always be complete, current, accurate, uninterrupted, secure, or error-free.
Except for warranties or consumer rights that cannot lawfully be excluded, the Services and products are provided “as is” and “as available.”
To the fullest extent permitted by law, we disclaim implied warranties or conditions, including implied warranties of merchantability, merchantable quality, fitness for a particular purpose, durability, title, and non-infringement.
We do not guarantee that:
- The Services will always be available or uninterrupted.
- Website errors will always be corrected immediately.
- Digital product representations will appear identically on every screen.
- A product will satisfy every customer’s subjective aesthetic, religious, artistic, or decorative preference.
- Delivery will occur on an exact date unless expressly guaranteed in writing.
This section does not exclude any express product commitment made by us, any applicable product guarantee, or any warranty or consumer remedy that cannot lawfully be excluded.
Section 22 — Limitation of Liability
To the fullest extent permitted by applicable law, Maximal Trading LLC, Jesus Creations, our affiliates, partners, officers, directors, employees, agents, contractors, production partners, service providers, and licensors, and Shopify and its affiliates, will not be liable for indirect, incidental, special, exemplary, punitive, or consequential loss arising from or connected with the Services or a product.
This may include loss of profits, revenue, business opportunity, anticipated savings, goodwill, or data.
Where liability cannot lawfully be excluded but may be limited, our aggregate liability arising from a particular order will not exceed the total amount paid for the product giving rise to the claim.
The limitations in this section apply regardless of whether a claim is based in contract, tort, negligence, strict liability, statute, or another legal theory and regardless of whether we were advised that the loss was possible.
Nothing in these Terms excludes or limits liability for:
- Fraud or fraudulent misrepresentation
- Wilful misconduct
- Death or personal injury caused by negligence where such liability cannot be excluded
- A breach of mandatory consumer law
- Any other liability that cannot lawfully be excluded or limited
Some jurisdictions do not permit certain exclusions or limitations. In those jurisdictions, this section applies only to the maximum extent permitted by law.
Section 23 — Indemnification
To the extent permitted by law, you agree to indemnify, defend, and hold harmless Maximal Trading LLC, Jesus Creations, Shopify, and our respective affiliates, partners, officers, directors, employees, agents, contractors, licensors, production partners, and service providers from third-party claims, losses, damages, liabilities, and reasonable legal fees arising from:
- Your material breach of these Terms.
- Your violation of applicable law.
- Your infringement of another person’s intellectual-property, privacy, publicity, or other rights.
- Customer Content submitted by you.
- Your fraudulent, malicious, or unauthorized use of the Services.
- Your unauthorized resale, reproduction, or commercial exploitation of our products or content.
We will provide reasonable notice of an indemnifiable claim where practicable.
Failure to provide prompt notice will not relieve you of your obligations except to the extent that the delay materially prejudices your ability to defend the claim.
We may control the defence and settlement of an indemnified claim at your expense, including the selection of counsel. We will not agree to a settlement imposing a non-monetary obligation directly upon you without your consent, which will not be unreasonably withheld.
You agree to provide reasonable cooperation in the defence of an indemnified claim.
This section does not apply to the extent prohibited by consumer law.
Section 24 — Force Majeure
We will not be responsible for a delay or failure caused by circumstances beyond our reasonable control.
Such circumstances may include natural disasters, extreme weather, fire, flood, epidemic, pandemic, war, terrorism, civil unrest, labour disputes, governmental action, customs restrictions, carrier disruption, transportation interruption, material shortages, utility failures, cyberattacks, or failure of essential third-party infrastructure.
Where an event continues for an extended period and materially prevents fulfilment, we may cancel the affected order and refund any amount paid for products not supplied.
This section does not remove any right or remedy that cannot lawfully be excluded.
Section 25 — Severability
If any provision of these Terms is determined to be unlawful, void, invalid, or unenforceable, that provision will be enforced to the fullest extent permitted by law.
The unenforceable portion will be treated as severed from these Terms without affecting the validity or enforceability of the remaining provisions.
Section 26 — Waiver and Entire Agreement
Our failure to exercise or enforce a right or provision under these Terms does not constitute a waiver of that right or provision.
These Terms, together with our Privacy Policy, Refund Policy, and other policies or rules posted through the Services, constitute the entire agreement between you and us concerning your use of the Services and supersede prior or contemporaneous communications concerning that subject.
This provision does not exclude any representation or right that cannot lawfully be excluded.
Any ambiguity will be interpreted fairly and according to applicable law and will not automatically be construed against either party solely because that party drafted the wording.
Section 27 — Assignment
You may not assign, transfer, delegate, or license your rights or obligations under these Terms without our prior written consent.
Any attempted assignment in violation of this section is void to the extent permitted by law.
We may assign or transfer these Terms and our associated rights and obligations as part of a merger, restructuring, sale of assets, financing, corporate reorganization, or transfer of the Jesus Creations business, subject to applicable law.
Section 28 — Governing Law and Jurisdiction
These Terms and any dispute or claim arising from or relating to the Services, a purchase, or these Terms will be governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law principles.
Subject to any mandatory consumer right to bring proceedings in another competent jurisdiction, the state and federal courts located in Florida will have jurisdiction over disputes arising from or relating to these Terms or the Services.
You and Maximal Trading LLC consent to the jurisdiction of those courts, except where applicable consumer law provides otherwise.
For customers located outside the United States, this choice of law does not deprive you of mandatory consumer protections provided by the law of your country of habitual residence where those protections apply regardless of the chosen law.
Section 29 — No Third-Party Beneficiaries
Except where these Terms expressly provide otherwise, these Terms do not create enforceable rights for a person or entity that is not a party to them.
Section 30 — Headings
Section titles and headings are included for convenience only and do not limit or otherwise affect the interpretation of these Terms.

You may review the current version of these Terms on this page.
We may update, modify, or replace part or all of these Terms by posting an updated version through the Services.
Where required by law, we will provide notice of a material change.
Unless otherwise stated or required by law, changes become effective when posted and apply prospectively.
The Terms in effect when an order is placed will generally govern that order, unless a later change is required by law or expressly accepted by both parties.
Your continued use of the Services after an updated version becomes effective constitutes acceptance of the updated Terms, to the extent permitted by law.
